TRAI Exempts SMS Limit per Day for Computer Generated Messages

Telecom Regulatory Authority of India (TRAI) has exempted machine to machine and person to machine SMS messages from 200 SMS per day limit. Earlier, TRAI has enforced limit of 100 SMS per day for all types of messages which it later increased to 200 SMS per day. However, that notification about limiting the number of SMS was valid for all types of messages – mobile to mobile, computer to mobile etc. That enforcement was put to control number of pesky or unwanted telemarketing SMS messages. However, it resulted into lots of confusion as it deters even the genuine SMS messages from reaching to its target audience. For example, there was a scenario wherein SMS message is sent from computer system automatically in case of any financial transactions, from company to its employees, radio taxi booking messages, goods delivery messages, status of complaints messages etc. Due to the earlier cap of 200 SMS per day, all these genuine requirements also started getting adversely impacted. This made not only the company but the subscribers as well quite unhappy as there lost all the genuine /non-spam communication from reaching them.

TRAI’s Exemption on Machine to Machine SMS Messages Notification

Many companies were in talk with TRAI since the enforcement came into force and wanted to get exemption for transmitting the genuine messages. TRAI has now agreed to their representation and have issued an official notification dated 25 Jan 2012 wherein TRAI has agreed to exempt the computer to mobile SMS messages which are mostly of nature as described above.

However, please be informed that this exemption is only for the nature and category of SMS messages as discussed above. For rest of subscribers, the earlier limit of 200 SMS per day will continue to be in practice.

This will be a welcome change by TRAI and it will give a sigh of relief to most of the companies and corporate houses who needed an exemption on number of SMS per day limit.
